Terms & Conditions

1. DEFINITIONS
1.1.
"Company" means Well Garden Retreats Ltd, trading from 9 Stratfield Park, Elettra Avenue, Waterlooville, PO7 7XN.
1.2.
"Customer" refers to the person or persons placing the order and agreeing to the contract. "Project" means the agreed supply, delivery, and installation of the building and any additional specified works.
1.3.
"Agreement" refers to the full contract between the Company and the Customer, including these Terms & Conditions and any accompanying specifications.
1.4.
"Building" refers to the structure being designed, delivered, and installed by the Company. "Deposit", "Delivery Payment", and "Build Payment" refer to the staged payments as outlined in Clause 4.
1.5.
"Completion" means the point at which the Company has handed over the building to the Customer, including all agreed works.
1.6.
"Force Majeure" means any unforeseen event beyond the Company's reasonable control.
2. SCOPE OF CONTRACT
By paying the Deposit, the Customer enters into a binding agreement with the Company for the design, supply, and installation of the specified project. This Agreement is subject to these Terms unless explicitly amended in writing and signed by a director of the Company.
3. JURISDICTION
This Agreement is governed by the laws of England and Wales. Any legal disputes will be handled by the courts local to the Company unless otherwise agreed.
4. PAYMENT TERMS
4.1.
All payments are made in advance, in the following stages:
4.1.1.
Deposit - Payable at the time of order (amount agreed in the quotation).
4.1.2.
Delivery Payment - Payable in advance of delivery of materials to site.
4.1.3.
Build Payment - Payable prior to commencement of the installation/build.
4.2.
The project will not proceed to the next stage unless the relevant payment has been received in full.

5. TITLE & RISK
Ownership of the building remains with the Company until full payment has been received. Risk and responsibility for the materials pass to the Customer upon delivery to site.
6. WARRANTIES
6.1.
We stand by our work and offer the following warranties
6.1.1.
10-Year Structural Warranty - Covering the core building framework.
6.1.2.
12-Month Workmanship Warranty - Covering construction, electrical and plumbing work.
6.2.
Additional components may be covered under manufacturer warranties (e.g. EPDM membrane, wood treatment, fenestration, etc.).
6.3.
Natural materials will vary in grain, texture and weathering. These are considered part of their character and are not deemed defects.
6.4.
Full warranty terms available upon request.
7. CANCELLATIONS & POSTPONEMENTS
7.1.
Orders can only be cancelled with written consent from the Company.
7.2.
If materials have already been ordered or manufacturing started, cancellation fees will apply.
7.3.
If installation is delayed by the Customer after materials have been delivered, storage charges may apply at £75 per week.
8. ACCESS & RESPONSIBILITIES
8.1.
The Customer is responsible for:
8.1.1
Ensuring clear access to the installation site.
8.1.2
Providing water, electricity, and other basic site services where needed.
8.1.3
Securing the site and materials once delivered.
9. FORCE MAJEURE
9.1.
We will not be liable for any delay or failure to perform our obligations if caused by events beyond our reasonable control.
10. LIABILITY
10.1.
The Company's liability shall be limited to the value of the contract.
10.2.
We do not accept liability for indirect losses, including loss of enjoyment, business, or income.
11. ENTIRE AGREEMENT
These Terms form the full agreement between Well Garden Retreats Ltd and the Customer.
Any changes must be made in writing and agreed by both parties.
